These Terms of Service govern access to and use of the Waternomi website and the purchase of Waternomi products.

The website is operated by Waternomi, having its registered address at 62 Balkrishna Society, Near Aadinath, Mumbai, Maharashtra 400042, India, referred to as “Waternomi”, “we”, “us” or “our”.

By accessing the website, creating an account or placing an order, you agree to these Terms and the policies linked on the website, including the:

• Cancellation and Order Modification Policy
• Return, Replacement and Refund Policy
• Limited Product Warranty and Support Policy
• Shipping and Delivery Policy

If you do not agree, please do not use the website or place an order.

1. Eligibility

You must be legally capable of entering into a contract to place an order.

If you use the website on behalf of another person or organisation, you represent that you are authorised to do so.

Waternomi aims to present accurate product descriptions, specifications, prices and images.

However:

• Colours may vary slightly according to lighting, photography and display settings.
• Packaging or non-material product details may change.
• Measurements may be subject to reasonable manufacturing tolerances.
• Product performance may vary according to water quality, pressure, temperature, usage and maintenance.
• Cartridge life is an estimate and may vary according to incoming water conditions.

Waternomi may correct genuine typographical, technical, pricing or specification errors.

4. Product Scope and Important Disclaimers

The Waternomi Shower Filter is intended for bathing-water use.

Unless expressly stated and supported by approved testing, the product:

• Is not a drinking-water purifier
• Is not a complete water softener
• Does not reduce TDS
• Does not treat disease or a medical condition
• Is not a substitute for plumbing correction, tank maintenance or source-level treatment
• Does not guarantee a particular cosmetic or dermatological result

Statements concerning skin, hair, freshness, shower experience or beauty routine describe the intended product context and should not be interpreted as medical advice.

Customers with a medical or dermatological concern should consult a qualified professional.

5. Pricing and Taxes

Unless stated otherwise:

• Prices are displayed in Indian Rupees.
• Product prices include applicable GST.
• Shipping, COD or other permitted charges may be shown separately before order confirmation.
• Prices and promotional offers may change without notice before an order is accepted.

If a product is listed at an obviously incorrect price because of a technical or human error, Waternomi may contact the customer for instructions or cancel and refund the order.

6. Orders and Acceptance

Placing an order constitutes an offer to purchase.

Receipt of an automated order-confirmation message does not necessarily constitute final acceptance. Waternomi may verify payment, inventory, address and transaction information before accepting and dispatching the order.

Waternomi may refuse or cancel an order where:

• Stock is unavailable
• Payment fails
• Pricing or information is materially incorrect
• The delivery location is unserviceable
• Fraud or unauthorised activity is suspected
• Applicable restrictions prevent fulfilment
• The customer has repeatedly refused COD orders
• Circumstances beyond reasonable control prevent fulfilment

An eligible prepaid amount will be refunded where Waternomi cancels the order.

7. Payment

Available payment methods will be displayed during checkout.

Payments may be processed by independent payment-service providers. Customers must use a payment method they are authorised to use.

Waternomi is not responsible for a payment provider's independent processing delay, service interruption or security practice, except to the extent responsibility cannot lawfully be excluded.

8. Delivery

Delivery is governed by the Shipping and Delivery Policy.

Estimated timelines are not guaranteed where delays arise from:

• Courier operations
• Weather
• Public holidays
• Incorrect customer information
• Remote-location restrictions
• Government action
• Force majeure
• Other circumstances outside Waternomi's reasonable control

9. Cancellation, Returns, Refunds and Warranty

Cancellation, return, replacement, refund and warranty requests are governed by the applicable policies published on the website.

The customer agrees to follow the stated procedure and provide reasonable evidence required to evaluate a claim.

Nothing in these Terms removes mandatory remedies available under applicable consumer law.

10. Promotions and Coupon Codes

Promotions may be subject to:

• Validity periods
• Minimum order value
• Product exclusions
• Customer or usage limits
• Geographic restrictions
• Specific campaign terms

Unless expressly stated:

• Promotions cannot be combined.
• Coupon value is not redeemable for cash.
• Refunds are based on the amount actually paid.
• Waternomi may disable a coupon affected by an error, unauthorised sharing, manipulation or abuse.
• Cancellation or partial return of a bundle may lead to recalculation of the retained products.

Material terms of an offer will be disclosed with the offer.

11. Intellectual Property

The website and its content, including the Waternomi name, logo, product names, technology names (including NomiCore™), photographs, videos, music, graphics, product designs, written content and software, are owned by or licensed to Waternomi.

You may use the website for personal and non-commercial purposes.

You may not, without permission:

• Copy or commercially exploit website content
• Reproduce product photographs or videos
• Use Waternomi trademarks
• Reverse engineer protected website functionality
• Misrepresent an association with Waternomi
• Sell counterfeit or unauthorised Waternomi products

12. Reviews and User-Submitted Content

If you submit a review, photograph, video, testimonial or other content, you confirm that:

• It is accurate and based on genuine experience.
• You have the right to submit it.
• It does not infringe another person's rights.
• It is not unlawful, misleading, abusive or defamatory.

Where you separately consent to publication, you grant Waternomi permission to display, format and reproduce the submitted content for Waternomi's website and brand communication.

Waternomi may moderate or remove content that violates these Terms but will not manipulate genuine reviews to create a misleading impression.

13. Prohibited Use

You must not:

• Use the website unlawfully
• Attempt unauthorised access
• Introduce malicious software
• Interfere with website operation
• Submit fraudulent orders or claims
• Misuse promotions or coupons
• Scrape or copy content for commercial use
• Impersonate another person

16. Limitation of Liability

To the maximum extent permitted by law, Waternomi will not be liable for indirect or consequential losses that were not reasonably foreseeable and did not arise directly from Waternomi's breach.

Waternomi does not exclude or limit liability where doing so would be unlawful, including mandatory consumer rights and liability that cannot legally be excluded.

17. Indemnity for Misuse

You may be responsible for losses reasonably suffered by Waternomi as a direct result of your unlawful use of the website, fraudulent claim, infringement of intellectual-property rights or material violation of these Terms.

This clause does not apply to legitimate exercise of consumer rights.

18. Force Majeure

Waternomi will not be responsible for delay or failure caused by events beyond reasonable control, including natural disasters, extreme weather, epidemic, government restrictions, transport disruption, labour disruption, system failure or interruption of essential services.

Waternomi will take reasonable steps to communicate and mitigate the effect of such events.

19. Suspension and Termination

Waternomi may restrict access where a user materially breaches these Terms, attempts fraud, compromises website security or engages in unlawful activity.

Termination will not affect an accepted payment, existing order, accrued obligation or mandatory consumer right.

20. Changes to These Terms

Waternomi may update these Terms to reflect changes in products, website functionality or law.

The revised Terms will display an updated effective date. Changes will not retrospectively remove rights already accrued under an accepted order.

21. Severability

If one part of these Terms is found unenforceable, the remaining provisions will continue to apply to the extent legally permissible.

22. Governing Law and Jurisdiction

These Terms are governed by the laws of India.

Subject to applicable consumer rights concerning jurisdiction, disputes will fall under the jurisdiction of the competent courts at Mumbai, Maharashtra.

The parties may first attempt to resolve a dispute through good-faith communication.
